1. What this service is
We provide the software that lets a photography business run an online store: hosting event photos, generating watermarked previews, and taking payment from buyers.
The business, not us, sells to the buyer.Payments are processed directly to the business's own payment account. The business is the seller of record for every purchase, is responsible for its own tax obligations, and handles questions about the photos themselves.
2. Your responsibilities as a business
By uploading content you confirm, for every image, that:
- You own the copyright, or hold a licence that permits you to sell it.
- You held any accreditation, permission or access rights needed to photograph the event, and to sell the resulting images commercially.
- You have any consents required for images of identifiable people, including where children appear, and you have complied with data protection law in obtaining them.
- The image does not breach the restrictions in section 3.
For images of identifiable individuals you are the data controller; we process that content on your instructions in order to provide the service.
3. Content that is not allowed
You must not upload, and must not use this service to distribute:
- Anything unlawful under Irish or EU law.
- Child sexual abuse material, or any sexualised depiction of a minor. We report this to the relevant authorities.
- Intimate or sexual images shared without the subject's consent.
- Material that incites violence or hatred, or that harasses an individual.
- Content that infringes someone else's copyright, trade mark or other rights.
- Images taken in a place or circumstance where photography was prohibited, or where the subject had a reasonable expectation of privacy.
4. Our right to remove content and suspend accounts
We may remove any image, unpublish any event, or suspend or close an account, where we reasonably believe these terms have been breached, where we are required to by law, or where we receive a credible report of illegal content.
Where we can, we will tell you what was removed and why. Where the law requires immediate action, or telling you would prejudice an investigation, we may act first.
Removing an image does not automatically entitle a business to a refund of platform fees, and does not by itself oblige us to refund buyers on your behalf.
5. Reporting content
If you believe an image on this service is illegal or breaches these terms, contact us with the page address and a description of the problem. We review reports and act on them promptly.
6. Indemnity
You are responsible for the content you upload. You agree to indemnify us against claims, losses and reasonable legal costs arising from content you uploaded, from your breach of these terms, or from your infringement of anyone else's rights.
7. Buyers
A photo download is licensed for personal, non-commercial use. You may not resell, redistribute or sublicense it, and you may not remove or obscure any watermark on a preview image.
Because a download is delivered immediately, you are asked at checkout to consent to immediate access and to acknowledge that you therefore lose the 14-day right of withdrawal that would otherwise apply to digital content. Your receipt records that consent.
8. Availability and liability
We aim to keep the service available but do not guarantee uninterrupted access, and we are not liable for a business's loss of sales during an outage. Nothing in these terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.
9. Changes and governing law
We may update these terms. Material changes will be notified, and the version above will change. These terms are governed by the laws of Ireland.
